A Discussion of Health Care Reform

A discussion of health care reform by UNICO MIDLANDS   We have seen countless articles on the subject of what employers will face in the way of penalties if they don’t follow the new federal mandates for health care reform. The following are some of the most recent issues being discussed. Submitted by Mick Sibbel Large Employer Status Only companies that meet the large employer threshold are subject to ACA’s pay or play rules. To qualify as a large employer, a company must have at least 50 full-time employees, including full-time equivalents (FTEs). To determine if a company is a large employer, aggregation rules apply for companies that are related or commonly owned. Specifically, all employees of a controlled group of businesses under Internal Revenue Code (Code) sections 414(b) or (c) or an affiliated service group under Code section 414(m) are taken into account to determine if an employer is subject to the pay or play rules. If the combined […]

Health Savings Accounts May Offer a Tax Deduction

Health Savings Account May Offer a Tax Deduction Don’t forget that you may have a tax deduction waiting if you have an underfunded Health Savings Account and you act before April 15, 2013. A Health Savings Account (HSA) is a tax-favored account used in conjunction with an HSA-compatible health plan. The HSA allows you to contribute funds on a pre-tax or tax-deductible basis, which you may use to pay for eligible medical expenses. Contribution Tax Benefits If your employer offers a payroll deduction through a Section 125 Cafeteria Plan, you can make contributions to your HSA on a pre-tax basis. The deduction is removed from your paycheck prior to taxes being applied and deposited into your HSA. Ask your employer if they facilitate pre-tax deductions. Contributions can also be made post-tax as an “above-the-line” deduction. This means you can reduce your taxable income by the amount you contribute to your HSA. Tax Deduction for Contributions Health Savings Account (HSA) contributions […]

The ACA Penalty

We have seen countless articles on the subject of what employers will face in the way of penalties if they don’t follow the new federal mandates for health care reform. The following article is a summary of the best articles we have found from industry sources. Health care reform known as the Affordable Care Act (ACA) goes into effect Jan. 1, 2014. If you are an employer with 50 or more employees, the ACA requires “shared responsibility” for affordable health insurance coverage and imposes a tax penalty if the requirement is not met. Small businesses with less than 50 FTEs will be exempt from the employer coverage “mandate”. For employers of less than 50 FTE then the rules are much simpler and they may be eligible for a health insurance tax credit. Any employer with 50+ full-time equivalents (FTE) is considered a large employer. This includes all part time employees and the hours they work each month. A specific formula […]

Health Care Reform: What to do now

Employers now have less than a year to prepare for the arrival of the core of the Patient Protection and Affordable Care Act, which requires employers with 50 or more full-time employees to offer medical coverage or pay a penalty. The decision isn’t an easy one and it has complications. First thing to know – Will you be in the 50+FTE category? Once you know that answer it will a lot easier to determine your next steps. Any employer with 50 or more full-time equivalents (FTE) is considered a large employer. If you fall into this category you need to start looking at the issues in more depth now to allow several months for your planning window. Smaller employers with less than 50 FTEs will be exempt from the employer coverage “mandate” which starts in 2014. While they should still gather information to understand how changes will impact them, the real need for change will be further down the road. […]

Health Care Reform (ACA)

Some key issues employers should know about health care reform (ACA) and the changes which will occur in the next few months. 1. Which employers are affected most? All employers need to review the changes but large employers who qualify under the large employer – 50 FTE formula must be especially aware. For purposes of the penalties under the employer shared responsibility mandate, full-time is defined as an employee that works an average of 30 hours or more a week. Small businesses with less than 50 FTEs will be exempt from the employer coverage “mandate”. A small employer is eligible for the tax credit if it has between 10 and 24 “full-time equivalent employees” with respect to any taxable year. Small businesses are eligible to receive up to 35 percent of their contributions toward their employees’ health insurance premiums if they contribute at least 50 percent of the total premium cost. 2. What is the large employer 50 FTE formula? […]
